Privacy Terms

Terms of Service

1. Agreement and operator

These Terms are an agreement between you and Schwinn Media, a sole proprietor operating Kitdeck.io from Altstetterstrasse 183, 8048 Zurich, Switzerland ("Kitdeck", "we", "us", or "our").

By creating an account or using Kitdeck, you agree to these Terms and acknowledge our Privacy Policy. If you use Kitdeck for a business or another person, you confirm that you have authority to act for them.

2. Eligibility

You must be at least 18 years old, have legal capacity to enter a binding agreement, and not be prohibited from using the service under applicable law. You may not use Kitdeck if we previously suspended or closed your account for a material breach.

3. What Kitdeck provides

Kitdeck lets creators:

  • sign in using an emailed magic link or one-time code;
  • connect supported YouTube, Instagram, and TikTok accounts through official APIs;
  • retrieve and display profile, audience, content, and performance analytics;
  • build and customise a creator profile, portfolio, rates, and proposal; and
  • create recipient-specific links and receive a notification when a link is first opened externally.

Kitdeck is currently provided free of charge. We do not process creator-brand payments and are not a party to any sponsorship, collaboration, or other agreement between you and a recipient. Rates displayed in a media kit are information you provide, not an offer or guarantee by Kitdeck.

4. Third-party platforms

Kitdeck depends on APIs and data supplied by Google/YouTube, Meta/Instagram, and TikTok. You authorise Kitdeck to access the selected account through the permissions shown by each platform. You confirm that the connected account belongs to you or that you are authorised to connect it.

Third-party data may be delayed, incomplete, inaccurate, or unavailable. Platforms can change their APIs, permissions, terms, or access without our control, which may limit or end a Kitdeck feature. Your use of each connected service remains subject to that platform's terms and policies.

5. Your account

You are responsible for access to your email account and activity through your Kitdeck session. Tell us promptly at hi@kitdeck.io if you suspect unauthorised access. Information you provide must be accurate and kept reasonably current.

You can disconnect a social platform, revoke a shared link, log out, or delete your account through the dashboard. Disconnecting stops data access and refreshes and deletes locally stored OAuth credentials and active refresh status, while previously imported encrypted social-account data and analytics history remain hidden until the same provider account reconnects; different provider accounts have separate retained histories. Creator-selected previous collaboration entries remain visible until you remove them or delete your account. Account deletion permanently disables your shared links and removes active and retained social data and other associated account data from active storage, subject to the backup and legal exceptions described in the Privacy Policy.

6. Your content and permission to operate the service

"Your Content" means profile information, social-platform data retrieved on your behalf, previous collaboration descriptions and tags, selected posts, rates, proposal text, recipient names, and other material you submit or choose to display. You keep your rights in Your Content.

You grant Kitdeck a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt for technical display, transmit, and show Your Content only as reasonably needed to operate, secure, maintain, and improve the service and to produce media kits at your direction. We may allow service providers to process it only for those purposes. This licence ends when the relevant content is deleted, except for temporary backup copies and legal retention described in the Privacy Policy.

You confirm that you have the rights and permissions needed to provide and share Your Content, that it does not unlawfully infringe another person's intellectual-property or privacy rights, and that your media-kit claims are not false or misleading.

7. Shared media kits

Shared-kit URLs are bearer links. Anyone with the URL can view the sections selected for that link without authentication and may forward or copy what they see. You are responsible for choosing appropriate content and recipients. Kitdeck applies no-indexing, no-referrer, and cache controls, but cannot control a recipient's screenshots, copies, or onward disclosures.

You can revoke a link at any time. Revocation blocks future Kitdeck access but cannot retrieve information already seen or copied by a recipient. View counts and notifications indicate technical link access only; they do not prove that a particular person reviewed or accepted your proposal.

8. Acceptable use

You must not:

  • use Kitdeck unlawfully or to deceive, harass, or harm another person;
  • fabricate, manipulate, or materially misrepresent analytics, identity, rates, or collaborations;
  • connect an account or share content without the required authority;
  • probe, bypass, or interfere with authentication, security, access controls, or service operation;
  • introduce malicious code or use automated scraping, bots, or excessive requests that burden the service;
  • access another user's account or non-public data without permission; or
  • resell or commercially reproduce the service itself without our written permission.

9. Kitdeck intellectual property

Kitdeck's software, design, branding, documentation, and other service materials, excluding Your Content and third-party materials, belong to Schwinn Media or the relevant licensors. These Terms give you a limited, revocable, non-transferable right to use the service as intended. They do not transfer ownership of Kitdeck or permit you to copy, reverse engineer, distribute, or create a competing service from protected parts of Kitdeck except where applicable law expressly permits it.

10. Privacy

Our Privacy Policy explains the personal data we process, why we process it, how long we retain analytics and account information, whom we share it with, and the choices available to you.

11. Availability and changes to the service

We aim to provide a useful and reliable service, but we do not promise any minimum uptime or continuous availability. Kitdeck may be unavailable because of maintenance, security work, third-party outages, API changes, or events outside our control. We may change, suspend, or discontinue any feature or the service as a whole. Where practical, we will provide notice of a material change that significantly reduces or ends the service.

12. Disclaimers

To the extent permitted by law, Kitdeck is provided "as is" and "as available." We do not guarantee uninterrupted operation, continued third-party API access, a particular commercial result, or that social-platform data is complete, accurate, or current.

We do not guarantee that content, analytics, or other data stored through Kitdeck will remain available, recoverable, or free from loss or corruption. You should keep independent copies of any information you need.

Media kits, calculated engagement, analytics, rates, and notifications are informational tools. You remain responsible for checking information and making your own commercial, tax, legal, and financial decisions. Nothing in Kitdeck is professional advice.

13. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for intentional misconduct or gross negligence. Subject to that rule and to applicable consumer law, Kitdeck is not liable for indirect or consequential loss, lost profit, lost opportunity, loss caused by third-party platforms, or decisions made from media-kit information.

Where liability may lawfully be limited, our aggregate liability arising from the free service is limited to CHF 100. This limitation does not reduce mandatory rights available to consumers under applicable law.

14. Suspension and termination

You may stop using Kitdeck and delete your account at any time. We may restrict or terminate access if you materially breach these Terms, create a security risk, misuse a third-party platform, or if suspension is required by law. Where reasonable and lawful, we will give notice and an opportunity to correct the problem.

When the account ends, your right to use Kitdeck ends and account data is handled under the Privacy Policy. Provisions that by their nature should continue, including intellectual-property, disclaimer, liability, governing-law, and accrued-right provisions, survive termination.

15. Changes to these Terms

We may revise these Terms to reflect service, legal, or security changes. If a change materially affects existing users, we will provide reasonable advance notice by email or through the service where practical. Continued use after the effective date means you accept the revised Terms; if you disagree, you must stop using Kitdeck and delete your account.

16. Governing law and general terms

These Terms are governed by Swiss law, without regard to conflict-of-law rules. Courts in Zurich, Switzerland have jurisdiction, except where mandatory consumer law permits you to bring a claim elsewhere.

These Terms and the Privacy Policy are the agreement about your use of Kitdeck. If one provision is invalid, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our consent. We may transfer the service and these Terms as part of a genuine reorganisation or sale, subject to applicable law and notice where required.
